This order prohibits Mr. Ballard from being in the same vicinity as Ms. Borys, following serious allegations of sexual misconduct.

During today’s hearing, counsel for Mr. Ballard made a startling admission in open court, confirming that DNA evidence, specifically semen, linked to Mr. Ballard, was found on a leather skirt belonging to Ms. Borys. Ms. Borys has been unable to obtain a full copy of the forensic report from the Utah Crime Lab, as the investigation remains part of ongoing criminal inquiries involving Mr. Ballard.

Ms. Borys alleges that Mr. Ballard sexually assaulted her at his Lindon, Utah office located within Dowdle Art Studios, shortly before his departure for an operation in Mexico. In court, Mr. Ballard’s legal team presented an explanation that only raises further questions: they claimed that Mr. Ballard, while on an undercover mission, engaged with a high-end escort to gather intelligence. According to his counsel, he “could no longer control himself,” and allegedly masturbated onto the leather skirt, which was inexplicably located on his Ritz-Carlton hotel room. Crucially, WhatsApp messages from the escort, attached to the court filings, confirm that Mr. Ballard, operating under the alias “Brian Black,” expressed a desire for intercourse with the escort, who demanded extra payment for the encounter.

Additionally, a photograph of the escort was presented, corroborating the sexual engagement Ballard had described in his defense. Despite the extraordinary nature of these revelations, serious questions remain unanswered. The protective order, granted today, ensures that Ms. Borys will not have to endure further proximity to Mr. Ballard as she continues to seek justice.
